GENERAL PURCHASE CONDITIONS
1. Object
1.1 These general purchase conditions (hereinafter, the “Conditions”) are applicable to the packaging, containers and similar products (the "Product" or "Products") offered by STARBOX SPECIAL PACKAGING, S.L. through its website www.tiny-tubes.com (the "Website").
1.2 The Website is owned by STARBOX , a Spanish company based at C/Francesc Macià, 39-41, Polígono Industrial Can Terrers, 08530, La Garriga, Barcelona, with tax number (NIF) B-61.544.581, duly registered in the Barcelona Mercantile Registry under Sheet B-267,726, Folio 133, Volume 35,437, Entry 1.
1.3 STARBOX provides information about the Products, and offers the possibility of acquiring them via the Website. People who intend to purchase the Products must complete a registration form prior to the purchase process and follow the instructions given by STARBOX on the Website.
1.4 The Conditions, and the Legal Notice contained on the Website, are the only conditions applicable for using the Website and purchasing Products from it, replacing any other that may exist. Consequently, the Customer (the “Customer”) who accesses, registers on or purchases Products from the Website agrees to submit to and is bound by these Conditions and the Legal Notice, as written when the Website is accessed.
1.5 All Customers accessing and registering on the Website must be at least 18 (eighteen) years old or have the authorisation of their parents or legal guardians.
1.6 The contract is written in Spanish and regulated by Spanish law, specifically Royal Decree 1/2007, November 16, which approves the revised text of the General Law for the Defence of Consumers and Users (“LDCyU”) and related laws, and by Law 34/2002, July 11, on the Information Society Services and Electronic Commerce (“LSSI”).
2. Product Information
2.1 The photographs, graphic or iconographic representations and videos related to STARBOX Products, as well as trade names, trademarks or distinctive signs of any kind contained on the Website, are intended to provide the most descriptive information about the Product. STARBOX will take all reasonable precautions to ensure that the description of the Products that appear on the Website is correct. However, the Customer must bear in mind that they are for guidance only and are therefore not exhaustive, so it cannot be guaranteed that all Product descriptions and images are exact, complete, reliable, up to date or without mistakes.
2.2 STARBOX reserves the right to decide the Products offered on the Website and may remove or add Products at any time. Unless otherwise stated, all new Products will be governed by the provisions of the Conditions in force at that time.
2.3 If a Product is not available after a purchase has been made, due to unforeseen circumstances, STARBOX will inform the Customer by email of the partial or total cancellation of the order, and the Customer will have the right to be refunded for the amount of Product not received. Partial cancellation of an order does not give the right to complete cancellation of an order, without prejudice to the exercise of the right of withdrawal that corresponds to the Customer in accordance with the provisions of these Conditions.
3. Placing Orders
To place an order, the customer must follow a series of simple instructions that appear on the Website.
3.1 The customer must select the products they want to buy by pack or individually according to the desired product. Once the product is chosen, click the "Add to cart" button.
3.2 After choosing the product, the customer has the option of choosing compatible items offered by that product. Once the product choice is finished, click the "add to cart" button.
3.3 These products will be automatically added to the customer's shopping cart, located in the upper right corner, with an indication of the price of the products chosen. The customer can consult all the items in his shopping cart at any time.
3.4 The process of adding other products to the cart is done in the same way.
3.5 Once the purchase is complete, the customer must click on the cart (in the upper right of the screen), whereupon the purchase summary will be displayed. Press the "Finish purchase" button to make the purchase.
3.6 A customer must register before placing an order. All new users have to fill in the required fields at login. Registered users click on the registered customer tab and enter their email address and password.
3.7 Once registered, the customer must choose between collection in our warehouse or shipping. There are two types of preparation method: STANDARD Preparation (1-3 business days) or PRIORITY ORDER (24 hours on business days) which carries a supplement of 10€. If you choose warehouse pickup, you must choose our warehouse address.
3.8 The customer then chooses the payment method. If a Customer has a promotional code, now is the time to enter it, so that the corresponding discount will be applied before paying for the order. If delivery is chosen, payment by bank card, Paypal or bank transfer is allowed. If the customer chooses warehouse collection, they can pay by the aforementioned methods or in cash upon collection.
3.9 The customer will see a detailed summary of his purchase: the products and quantities ordered, the total cost (including taxes and delivery costs), the delivery address or warehouse address (for orders with warehouse collection), the payment method, delivery method and a field where the customer can add notes regarding the order. All these data can be modified using the modify button (next to the various order detail sections). When paying by bank transfer, the Customer will see the bank account number where the payment must be made below the order details.
3.10 Finally, the customer has to press the Confirm purchase button, below the order details whereupon an e-mail confirming the order will be sent.
3.11 By placing an order, the Customer acknowledges and declares he has read all the instructions given during the verification process and fully accepts these Conditions. The Customer places an order for Products through the Website by clicking on the "Place the order" button at the end of the purchase process.
3.12 Once the order has been sent, a page will appear with the phrase "Thank you for your purchase". The Customer will then receive an email from SUNBOX within 24 hours which includes an acknowledgment of receipt confirming acceptance of the order with a summary of the conditions, information on the Products features, their price, the payment method and delivery cost information.
3.13 If an order is not confirmed within 24 hours after being made (and it is a working day), the Customer can contact STARBOX for assistance, by email at orders@tiny-tubes.com or by calling 938 61 32 83. Customers may also contact STARBOX if they have any questions regarding an order. For faster service, Users should have their order number ready.
4. Delivery
4.1 Orders are processed and prepared for delivery on business days from 9 am to 6 pm. Orders placed outside this time - e.g. late on Fridays, at weekends or during public holidays - will be processed the following business day.
4.2 Delivery costs are paid for by the Customer and are reflected in the invoice.
4.3 The maximum delivery time for the Products is 30 calendar days from conclusion of the contract.
Deliveries within (peninsular) Spain take approximately 2-6 business days after payment is confirmed by the Customer. International shipments can take 3-7 business days, depending on the destination, the service selected and the indicated transport company. Once the package is delivered to the courier, the Customer will receive an email with the delivery tracking number.
STARBOX is not responsible for delays in the delivery of orders or, if it is impossible to send them, due to force majeure, when it is outside the control of STARBOX . A non-exhaustive list of examples of force majeure are: accidents, strikes, riots, threats or terrorist attacks, fire or explosion, weather or natural disasters, such as storms, floods, earthquakes, subsidence or epidemics; as well as other problems unrelated to STARBOX , with transport or telecommunications systems. Once the cause of delay or impossibility has been lifted, STARBOX will do everything it can to resume business activities and fulfil its obligations and deliveries.
4.4 All purchases are subject to prior authorisation from the bank, and only purchases with this authorisation will be processed. If the order cannot be processed, the Customer will receive an email.

5. Payment method
The forms of payment accepted by STARBOX are as follows:
5.1 Credit/Debit card
- Visa
- MasterCard
- American Express
The Products will be charged at the time the order is placed.
For Customer security, their name and delivery address must match the credit card used to make the payment. We reserve the right to cancel any order that does not meet these criteria.
All credit card holders are subject to validation and checks by the card issuer. If for any reason the Customer's payment card issuer denies payment authorisation, either before or after a payment, we will not be liable for any delay or non-delivery of the item.
5.2 Paypal
A Paypal account linked to a debit, credit card or bank account does not add extra costs unless there is a currency conversion.
5.3 Bank transfer
Once the payment has been made, Customers must send proof of payment and their order number to orders@tiny-tubes.com or via fax at +34 93 732 21 56.

Your order will be sent only after the transfer or supporting documentation is received.
5.4 Cash on collection
The Customer can choose to collect the Products purchased personally at the following address:

This payment method must be specified when the order is placed and the exact purchase amount must be provided at the time of collection as we cannot give any change in cash. Before collecting the Product, the Customer must have received an electronic notice with a number confirming the Product is ready to be picked up.
6. Delivery costs
6.1 Delivery costs are calculated based on the amount of product purchased, its volume and destination.
6.2 As the Canary Islands, Ceuta and Melilla are not part of the European Union customs area, shipments may be subject to customs duties and/or taxes. In most cases, the fees are charged at the time of delivery of the package, although the Customer may receive a notification by mail requesting they go in person to pay these fees before receiving the package. The fee amount may vary depending on the weight/amount of the package. For shipments to the Canary Islands, STARBOX includes the Single Administrative Document ("DUA") for export in the shipping cost; and, upon delivery, of the Product, the Customer/recipient must pay the Import DUA and the Indirect General Canary Islands Tax ("IGIC").
7. Enquiries about orders
7.1 Without prejudice to the provisions of point 4.5 of these Conditions, any Customer who has created an account at www.tiny-tubes.com may check the status of their orders by visiting the page "My Orders" in the section "My Account”.
7.2 When the Customer clicks on the "My Order Status" page, they will be required to log in with their email address and password. The order summary page provides Customers with detailed information about their current and previous orders. Once the order has been sent, the corresponding tracking number will be displayed, if available.
8. Cancelling orders
8.1 STARBOX may cancel an order for any of the following reasons, which are not exhaustive:
- Impossibility of processing payment information.
- Impossibility of delivering to the address provided.
- Cancellation by the Customer.
- Items not available.
9. Other purchase features
9.1 Deliveries are made by courier or groupage service.
9.2 All deliveries include Value Added Tax (VAT).
9.3 Delivery is understood to be the sending of the Products to the address specified by the Customer during the order process.
9.4 STARBOX delivers orders to the courier service within a maximum period of 48 hours.
10. Right of cancellation
10.1 Customers may exercise their right of cancellation without indicating any reason and return the Product to STARBOX within a period of 14 (fourteen) days from the day on which they received the Product.
10.2 However, the Customer must inform STARBOX in writing at the email address customerservice@tiny-tubes.com with the information required to locate the order in question. As soon as STARBOX receives the email with the order details, the Customer will be informed of the procedure to follow.
10.3 For additional information on the content and instructions for exercising the right of cancellation, please contact our Customer Service.
10.4 The right of cancellation will not apply if the Products are:
- Made according to Customer specifications or clearly personalised.
- Can deteriorate or expire quickly.
- Are sealed and are not suitable for return for health or hygiene reasons, or have been opened after delivery.
11. Effects of cancellation
11.1 The Customer must send the Product in pristine condition to the address provided by STARBOX no later than 14 (fourteen) calendar days from the date on which they informed STARBOX of their desire to do return it. STARBOX will then reimburse the Customer for all purchase costs, not including the direct cost of returning the Products, which will be borne by the Customer. Also, the Customer will be responsible any decrease in the value of the goods due to handling, other than that necessary to establish their nature, features or operation.
11.2 STARBOX will use the same means of payment that the Customer used in the initial transaction.
STARBOX may retain any reimbursement until it has received the Product(s) from the Customer or until the Customer provides proof of having returned the Product(s), whichever occurs first.
12. Guarantee
12.1 STARBOX is responsible for any lack of conformity in the Product for a period of 2 (two) years from delivery. Thus, if the Product is defective, STARBOX will be responsible for picking it up, exchanging it for another of identical conditions and paying the costs associated with this return and exchange (except for any additional costs due to choosing an express delivery method, in which case the Customer must bear the extra cost).
12.2 To manage the incident, the Customer must send an email to STARBOX at the address customerservice@tiny-tubes.com, informing it of the reason for the incident, the order number, the delivery note and send photographs of the damaged or erroneous product so the situation can be assessed. To exercise the right of guarantee, proof of purchase or a delivery note must be available.
Once this information is received, STARBOX will contact the Customer to explain the procedure to follow.
12.3 The Customer must inform STARBOX of the lack of conformity of the Product within 2 (two) months of becoming aware of it.
12.4 If it is not objectively possible to replace the Product with another of the same class, STARBOX will refund its cost price.
12.5 In no case will the guarantee provided in point 12.1 cover negligent or violent use of the Product or damages from the manipulation or intervention on the Product.
It is equally important that any instructions for use or installation of the Products delivered are followed at all times; if in any doubt, you should contact STARBOX for advice on the use of the Product.
13. Taxes
All prices include Value Added Tax (VAT), as well as any applicable tax or fee.
14. Prices
Products will be sold at the price indicated when the Customer provides valid confirmation of the order.
15. Validity
STARBOX reserves the right to modify prices, articles, offers and other commercial conditions without prior notice.
16. Waiver
16.1 If STARBOX does not request strict compliance by the Customer with any of the obligations assumed by it under a contract or these Conditions, or if it does not exercise the rights or actions that may correspond to it by virtue of a contract or these Conditions, it will not imply any waiver or limitation of these rights or actions or exonerate the Customer from complying with such obligations.
16.2 Any waiver by STARBOX of a specific right or action does not imply a waiver of other rights or actions derived from a contract or these Conditions.
17. Modification of the Conditions
STARBOX reserves the right to review and modify these Conditions at any time. Customers will be subject to the Conditions in force at the time they use the Website or place an order. If STARBOX has to make changes to these Conditions retroactively for legal reasons or following a decision by government agencies, these changes will also affect any orders the Customer made previously.
18. Complaints, comments and suggestions
18.1 A complaint form is available on request to Customers by sending an email to customerservice@tiny-tubes.com.
18.2 Customers may also request clarification or make suggestions or comments to our Customer Service during opening hours by phone at +34 93 732 21 56 or via the email address customerservice@tiny-tubes.com.
19. Data protection
19.1 For the purposes of the provisions of Organic Law 03/2018, of December 5, on the Protection of Data and guarantee of Digital Rights (LOPD), STARBOX informs the Customer that all personal data it provides voluntarily at any time to our company or our employees will be included in an automated personal data file created and maintained under the responsibility of STARBOX , and will be processed to deal with order requests or any queries or suggestions made.
19.2 Customers may exercise their rights of access, rectification, cancellation and objection at any time by communicating a request to the email address customerservice@tiny-tubes.com.
19.3 So that the information contained in our files is always up-to-date and does not contain errors, we ask the Customer to notify us as soon as possible of any modifications or changes to their personal details.
19.4 To guarantee the protection of your personal data and prevent their alteration, loss, processing and/or unauthorised access to them, we inform you that all the necessary technical and organisational security measures have been adopted, taking into account the state of the art, the nature of the stored data and the risks to which they are exposed, in accordance with the provisions of the LOPD and its implementing regulations.
19.5 Except in fields where it is expressly indicated otherwise, sending the information required in the data request forms is mandatory for the proper management of orders, queries and suggestions made by you. Failure to complete the mandatory fields or the provision of incorrect data will make it impossible for STARBOX to manage them properly.
20. Applicable law and jurisdiction
20.1 These Conditions are governed and interpreted in accordance with Spanish law.
20.2 The parties agree to submit any matter raised to the decision of the Courts and Tribunals of the city of Granollers (Spain), unless the Customer is a consumer for the purposes of article 3, LDCyU; in which case, the competent Courts and Tribunals will be those of the domicile of the Customer or STARBOX , as chosen by the Customer.
